System Guardian — Terms of Use

1. Acceptance of Terms

By downloading, installing, or using System Guardian ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not install or use the App.

2. Description of Service

System Guardian is a macOS menu bar utility that monitors system performance (memory, CPU, GPU) and provides tools to manage system resources, including:

Real-time monitoring of memory usage, CPU load, and GPU utilization
Display of running processes with resource consumption data
Manual and automated memory action operations
Process management (force quit)
Local notifications for system performance alerts
Configurable thresholds and optional automation rules

3. System-Level Operations — Important Warnings

⚠️ Process Termination

System Guardian can terminate (force quit) running processes at your request or automatically when configured. Terminating a process immediately ends that application, and any unsaved work is permanently lost. You are solely responsible for saving your work.

⚠️ Automated Process Termination (Auto Force Quit)

When Auto Force Quit is enabled, the App may automatically terminate selected user processes exceeding your configured memory threshold. Enabling this feature requires explicit user confirmation. Once enabled, actions may occur without an additional prompt at action time. By enabling this feature, you accept that:

Processes may be terminated without prior warning
Unsaved data in terminated applications will be lost
You have configured the memory threshold appropriately
Critical system processes (Finder, Dock, WindowServer, etc.) are intended to be protected

⚠️ Memory Actions

Intensive mode performs a stronger cache-pressure cycle. During this process, system responsiveness may temporarily decrease and some applications may slow down. Use at your discretion and save work before running intensive actions.

4. User Responsibilities

You are responsible for:

Saving all work before using process management features
Configuring automated features with appropriate thresholds
Maintaining backups of important data
Understanding the consequences of system-level operations
Ensuring the App is suitable for your intended use

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE COMPATIBLE WITH ALL MACOS CONFIGURATIONS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data, work, or unsaved content
Temporary performance impacts or workflow interruptions
Outcomes resulting from optional automated features you enable (Auto Force Quit, low-memory actions, scheduled memory actions)
Loss of profits, revenue, or business opportunities
Unexpected system behavior arising from user-configured actions

THE DEVELOPER'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €5.00, WHICHEVER IS GREATER.

In the EU, this does not affect your statutory consumer rights.

7. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, or expenses arising from your use or misuse of the App, violation of these Terms, or violation of any applicable law.

8. Governing Law

These Terms are governed by the laws of the Republic of Lithuania. For EU consumers, mandatory consumer protection laws of your country of residence also apply. You may use the EU Online Dispute Resolution platform.
